Please read these Terms and Conditions ("Terms") carefully before using the EchoTalent website and services (the "Service") operated by EchoTalent ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

"EchoTalent" refers to the website, services, and tools provided by EchoTalent AI.

"User" or "You" refers to any individual or entity accessing or using EchoTalent.

Acceptance of Terms

By registering for and/or using the Service in any manner, including but not limited to visiting or browsing the website, you acknowledge that you have read, understood, and agree to be bound by these Terms and any other applicable laws and regulations.

Modifications to Terms

EchoTalent reserves the right, at its sole discretion, to modify or replace these Terms at any time. Any changes will be effective immediately upon posting on the website. It is your responsibility to review these Terms periodically. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

Use of Services

EchoTalent provides AI-powered career tools and services to help users with their job search and career development. The services may include but are not limited to:

• AI-Powered Resume Builder
• Cover Letter Assistant
• LinkedIn Post Generator
• Career Path Mapping
• Job Application Tracker

EchoTalent may offer free and premium services, with additional features available for premium users. Usage of the Service is subject to the chosen plan and any associated fees.

Account Registration and Security

Users may be required to create an account to access certain features of EchoTalent. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and agree not to disclose it to any third party. You agree to take sole responsibility for any activities or actions under your account.

Subscription Plans and Payment

EchoTalent offers various subscription plans, including but not limited to monthly and annual plans with different levels of access and features. By selecting a subscription plan, you agree to pay the applicable fees and taxes associated with the plan. All fees are non-refundable except as expressly provided in these Terms or required by applicable law.

Monthly Unlimited Plan

The Monthly Unlimited Plan ("Plan") provides users with unlimited access to all EchoTalent tools and services for a monthly fee, subject to the Fair Usage Policy described below.

Fair Usage Policy

While the Plan offers unlimited access, it is subject to a maximum cap of 500 applications per month. This cap is in place to ensure fair use of the Service and to prevent abuse. Exceeding this cap may result in additional charges or suspension of your account, at EchoTalent's sole discretion.

Cancellation and Refund Policy

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, you will continue to have access to the Service until the end of your current billing period.

Refunds: Refunds are not provided for subscription fees already paid, except where required by law or at EchoTalent's sole discretion. If you have used a substantial portion of your allocated units or services, you may not be eligible for a refund. Refund requests will be evaluated on a case-by-case basis.

User Conduct and Responsibilities

You agree not to misuse the Service or help anyone else to do so. Misuse includes, but is not limited to:

• Violating any applicable laws or regulations.
• Infringing the intellectual property or other rights of third parties.
• Transmitting any viruses, malware, or other harmful code.
• Attempting to gain unauthorized access to the Service or other users' accounts.
• Using the Service to send unsolicited communications or spam.

Intellectual Property Rights

All content, features, and functionality available through the Service, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of EchoTalent or its licensors and are protected by intellectual property laws.

User Content

Users may submit content, such as resumes, cover letters, and other personal information, to EchoTalent. You retain ownership of your content but grant EchoTalent a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content solely for the purpose of providing and improving the Service.

You represent and warrant that you have the rights to grant such license and that your content does not infringe any third-party rights.

Privacy Policy

Your use of the Service is also subject to EchoTalent's Privacy Policy, which describes how we collect, use, and disclose your personal information. By using the Service, you consent to the collection and use of information in accordance with the Privacy Policy.

Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. EchoTalent makes no warranties, expressed or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

EchoTalent does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, in no event shall EchoTalent, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Indemnification

You agree to defend, indemnify, and hold harmless EchoTalent and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your access to or use of the Service.
• Your violation of these Terms.
• Your violation of any third-party right, including without limitation any intellectual property right or privacy right.
• Any claim that your content caused damage to a third party.

Termination

EchoTalent may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may discontinue using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Entire Agreement

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least [30 days'] notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
